Is the SSA Backing Ehrlich for Governor…?

The answer is “No,” of course the Social Security Administration (SSA) isn’t backing former Governor Ehrlich for Governor.

However, David Nawrocki – father of GOP Baltimore County Council candidate, Ryan “Shall Not Abuse” Nawrocki is backing Ehrlich, which is certainly his choice. David Nawrocki is, in fact, the 7th District Coordinator for Ehrlich’s 2010 MD GOP gubernatorial campaign.

What I didn’t know until last night, however, is that David Nawrocki, who was former top dog at the Republican Club of Northeast Baltimore County and who graciously hosted “Ehrlich Theme Team Meetings” at his Perry Hall abode, also works for the SSA.

So what? You may ask. Who cares? You may wonder.

Check out this completely verbatim (formatting changes from the cut’paste and the partial redaction of his phone numbers, notwithstanding) email from David Nawrocki that was forwarded to me last night by an individual on Ehrlich’s campaign list who was among its recipients….

Did you catch it – David Nawrocki’s odd wording in the body of the email that tells recipients to not reply because “we will lose your information,” but to instead “Copy and paste my email below into the “To” area of this email?” Why would Nawrocki made that suggestion?

Take another peek at the originating email address…which just happens to be David.Nawrocki@ssa.gov.

Can you say “Violation of the Hatch Act?” I knew you could. So did an attorney who was asked.

The fact David Nawrocki illegally sent an Ehrlich Campaign email from his federal government email account begs many questions, the least of which being: Considering David Nawrocki sent this email to the Ehrlich list on Monday, May 17, 2010 at 4:16:21 PM GMT -05:00 US/Canada Eastern (and was forward to me within 45 minutes) couldn’t he have waited a few hours to get home before sending it out?

Who the Hell is he trying to impress? What the Hell was he thinking? Is intelligence hereditary in the “family?”

Another, more serious, question would be: What is the Social Security Administration going to do about the fact its employee David Nawrocki used its computer/email accout to send out an absolutely blatant political email intended to bolster the election efforts of former Governor Ehrlich?

If the SSA is backing Ehrlich…we could expect Nawrocki to likely slide through unscathed for wasting the taxpayer dime and time in his political pursuits. If, however, the SSA is not backing Ehrlich, I would think it would want to prove its displeasure by taking appropriate measures against an employee who used its taxpayer funded time and dime to violate the Hatch Act.

(If the bosses at SSA kick David Nawrocki to the curb for his abuse of taxpayer funded equipment and time…perhaps he will end up cracking un-hatched eggs as a short order breakfast cook at some fine eatery…)

Whatever comes of this ludicrous “Duh!” episode, one thing is certain: David Nawrocki has proven that certain folks are no longer operating under the same old standard of mundane incompetence and stupidity.

By sending out a pro-Ehrlich “Let’s-get-Volunteers” political email from his federal government computer – and violating the Hatch Act in the process – David Nawrocki has founded, and presently stands proudly alone on, his own Special Level of Idiocy.

David Nawrocki should be fired. I support Bob Ehrlich very strongly because I believe he is the only chance COMMON SENSE voters have to beat O'Mouthy, but Nawrocki's actions are beyond the pale and unforgivable.
Moreover, I hope Bob is looking for a new coordinator in the 7th, where I live, because he can not allow this incident to become an anchor to his campaign. If he does not dump David, and Joe Steffen I think you have been incredibly unfair to Ryan Nawrocki, he is shaming both himself and his supporters. I would have to reconsider my support.

What a week, and it is only Tuesday. The Ehrlich crew enters a friendly state employee's e-mail address on O'Malley's campaign website knowing it will generate an e-mail to that address. The employee turns it over to the Republican party and, Presto! a manufactured controversy of miniscule proportions. (Surely this amateur effort must embarass the host of this blog.)
Then, before they can bask in the lukewarm glow of their "accomplishment" one of their compratriots gets caught in a not so small violation of Federal law. Priceless.
And, parenthetically, isn't it funny how so many of the small government guys love the huge government troughs like the Social Security Administration?

Seems to me that "Grant" is making some very nasty allegations about both Joe Steffen and Governor Ehrlich, and not offering any evidence to back it up.
Not only is he accusing Steffen of being something awful without offering any proof. He's alleging that the Ehrlich Administration committed a Watergate-style crime by covering up the "real" reasons behind his ouster.
This is lawsuit territory.

Lawsuit? At this point, by the mere existence of this Blog, Joe has put himself out as a 'public figure' and the laws of slander and libel do not apply to him. He has injected himself into the public-eye over and over and by no means is he a 'private citizen'. There are several people though, who at the time he referenced them on this blog were/are private citizens. If Joe was 17 years old I would not have a problem with his postings. Joe can you give us one more example or this an isolated (albeit careless) incident of clicking send from the wrong e-mail account? Interesting folks assume he is at work. Federal employees have access to their e-mail accounts at home too.
And it is quite a stretch to try to connect the activity or mistake of one to an entire campaign. Of course that is your entire point to smear Bob Ehrlich at any chance you can even if it means extrapolating that he once stepped on an ant and therefore he hates all insect-loving people.

Your FOIA request wont work with SSA. Because SSA processes PII, PHI and many systems are considered FOUO, that simply will not work. A lot of people on here have no idea regarding Hatch Act, Limited Personal Use of Government Resources, ROBs/AUPs for Federal Systems, FISMA, etc. My company has been providing investigative support to such cases in government for nearly 9 years and worked with the OIGs of nearly every federal agency. Its a very long shot to think anything will come out and anyone who does is living some wild fantasy.

Reading between the lines of your various postings, it is clear you are trying to allege that Steffen is a predator of some kind. In fact, above you state that you “heard (Steffen) like(s) the company of little boys.” You also hint that there were questionable materials on Steffen's state computer, and that this was the “real” cause of his termination. Lastly, you contend that these facts were hushed up, presumably to spare the Ehrlich Administration embarrassment.
Am I correct in what I just wrote? If so, I have a few questions:
1) Would you be willing to share publicly where you heard the allegation you made on Steffen’s blog? Moreover, would you be willing to publish any evidence you may have? I’m sure you’re aware that publishing such allegations on a blog – or threatening to publish them – without any corroborating evidence is both dangerous and irresponsible, leaving you vulnerable to various legal actions.
2) Steffen’s activities as a state employee were the focus of a multi-million dollar legislative investigation. His computer was subject to at least two forensic examinations – one by the state, and one by an outside examiner. The results of the latter examination were released to the media. If such materials did exist and – as you contend – "when you delete stuff it doesn't really get deleted," can you explain why didn’t it turn up then?
3) If Ehrlich Administration officials found illegal materials on a state computer and did not notify law enforcement authorities, then a Watergate-style cover up occurred. If true, this would disqualify Ehrlich from ever holding office again in the eyes of most Marylanders. It also raises questions as to whether officials involved in the “cover up” broke the law. In other words, the information you claim to have could influence the outcome of the 2010 gubernatorial election. Would you be willing to share your evidence with the public? The citizens of Maryland have the right to know if Governor Ehrlich and his aides obstructed justice, jeopardizing public safety in the process, for the sake of political expediency.
I anxiously await your answers to these questions.

The Maryland General Assembly spent millions of dollars investigating Gov. Ehrlich's hiring and firing practice which centered around Joe Steffen's actions on behalf of the the Governor. During this investigation, Mr. Steffen's computer was turned over to the investigating committee via a Subpoena Duces Tecum. If there were any such material as Grant has stated there is, I can assure you that the General Assembly would have brought it to light. So, now the burden has shifted to you Mr. Grant. Please provide the name of the person who gave you this information and any evidence you relied upon in drawing your conclusion about Mr. Steffen. The facts I'm relying on here are a matter of public record, thanks to exhaustive coverage in the Washington Post, The Baltimore Sun, and other print and broadcast media. Steffen's computer was examined because of the alleged hiring/firing and O'Malley rumor scandal.

In June 2007, Lurita Alexis Doan, then Administrator of the General Services Administration, was found by the United States Office of Special Counsel (OSC) of violating the Hatch Act when she sent letters asking how to help Republican politicians get elected, and was accused by Special Counsel Scott Bloch of lying to deliberately mislead investigators.
OSC determines whether it was accidental. However, the case is similar and the e-mail campaign that is the subject of this issue clearly identified that the author knew he was using a government email address pursuant to his "cut & paste" comment. This will be interesting to say the least. I am assuming that it has already been sent to the OSC.

Its funny all the adults here are picking on some college kid. I guess you are all mentally at the same age and most likely will be for the remainder of your rather insignificant lives.
I would hope that most people know that trust funds are protected from litigation outcomes. Its why families set them up for their children and beneficiaries. Also, its not the OSC that would determine Hatch Act violations. The OSC was engaged with her because she was a PAS – Senate Confirmed Presidential Appointee.
Title 17 protection actually goes pretty far and under Obama, its pretty unlikely any actions would be taken, as many of his people would fall under the same scrutiny.

The trust res is protected, not the beneficiary aspect of the trust and you are dead wrong about the OSC not considering this a Hatch Act violation. Funny t does not report to the Obama administraation or any administration for that matter. Their purpose is to investigate all government officials for waste, fraud and abuse. As far as the college kid is concerned…sometimes lesssons are hard learned. I am not sure what rock he crawled out from under, but his comments warrant the response. It would actually be the OIG for a specific agency that would investigate waste, fraud, and abuse. I know this because I was an investigator for seven years for the IGs of 12+ federal agencies. It would also require a pretty substantial gear of e-disco (Electronic Discovery) for those of you who do not know what that is. More to the fact in point, is that it would require an E3 span for the entire SSA, and of course would require a reliable chain of custody for the email. Unless the recipient is willing to provide his computer hard drive as evidence, and can himself document a strict chain of custody, then any court would rule said evidence inadmissible under e-disco provisions. I have sent an awful lot of people to jail as state's evidence for misuse of government computers, and I can tell you that one email violation will not even trigger anything.
A pattern of misbehavior and violation of the AUP/ROB would need to be documented over a course of at least six months, and even then, a PIP would have to be implemented and monitored before any real action would be taken.
I seriously doubt anyone here has worked as a federal investigator or in an IGs office. Im also pretty sure nobody here has ever held anything above a GS-9 in Federal Government.

Well…First of all this is totally investigated by the OSC. Their jurisdiction is paramount over a lowly OIG especially regarding political matters as they are an independent Agency. Second, you never sent anyone to jail. If you are an OIG investigator…chances are you referred it to the big boys at DOJ or the US Attorney's office in your jurisdiction. At that point they put him/her in jail. At best an OIG investigator is a mall security guard in comparison to the agencies under the control of the DOJ. So relax over there …your self agrandizing statements are wrought with innacuracies.

Yes. Every federal case is referred to the local US Attorney's Office. Much like police officers do not actually put anyone in jail; they refer their cases to the local DA or State's Attorney for prosecution. The OSC does not rely on the IG office of the various agencies. The form that you have to fill out regarding Hatch Act violations solicits feedback from anyone.

You are right. There is no criminal charge associated with the Federal employee. What happens is OSC investigates and there is a Merrit Systems Protection Board hearing that will determine if The employee loses his job or is suspended among other HR penalties. If there is a criminal act, then it gets referred to DOJ as previously mentioned.

I guess you read the first page and stopped. Go to page 280 and you can see that the powers vary from agency to agency. The book clearly states that in some agencies they are like mall cops, and in other agencies they have full authority to arrest people and execute search warrants.
I'm guessing you were the guy in law school who determined the case holding by the first three pages and failed to read the entire document. I guess you reading comprehension and long term attention skills are as superficial as your life; low and callous.

Why should we care about Steffen's daughter? To my knowledge, she is not a public figure. By contrast, Ryan the batterer is running for county council, and David the Hatch Act violator is a senior volunteer with Ehrlich's campaign. An OIG Special Agent is different from an Investogator in that he/she is granted police powers directly from the Attorney General's Office if an OIG can show that they would not be able to fulfill the mission of their agency without said powers.

As for the attack on Mr. Massoni, sounds like someone is a little, Green with envy? As for when does lack of a college degree disqualifies one from a job? As long as they can do the job and the boss is happy it isn’t anyone else’s business. I know a number of high level folks at NIH who have no college degrees yet they are GS 14s and 15s. Bottom line Joe Steffin needs to get some therapy he has some issues which he needs to work out. Like his obsession with Ryan Nawrocki and his family. Because if you had any political know how you’d know direct mail is one of the least effective means of communications. How many times have you tossed the Valpak envelope or the post card from some politician in the trash? Signs get your name out; you see those things every day? Haven’t you ever driven to NOVA for any reason around election time, the median strip on Lee Hwy or Route 7 are filled with signs, it is known as the “Sign Wars”. Furthermore in the 21st century direct email has replaced the costly direct mail. As for Ehrlich lack luster fundraising let’s just say your information is way off base. Doesnt Joe Steffen live with his felon convict daughter and her boyfriend. I hear she had a child out of wedlock. The boy's father is an ex-con too. Perhaps Liam Farrell, the Staff Writer misquoted Former Governor Bob Ehrlich who allegedly described "the last few Maryland Republican Party Red, White and Blue dinners as like a 'morgue'". Perhaps the Former Governor Bob Ehrlich had a lapse of memory about that 2009 event — where he and the now embattled Republican National Committee Chairman Michael Steele each handed out bronze Abraham Lincoln busts to past MD U.S. Congressmen and Congresswomen who were honored at that 2009 event. (So everyone reading this knows, in the 2006 election I was a strong supporter of Bob Ehrlich — unlike Former RINO Congressman Wayne Gilchrest. And was a strong supporter of Michael Steele when he ran for the Senate that same year and also when he ran for Chairman of the Republican National Committee.)
I realize that The Capital has seldom missed an opportunity to put Republicans in the worst possible light and this may be one of those "reporting as usual" events. In any event, I believe in telling the truth and the actual truth is that most of the previous Red, White and Blue Dinner events held under the Chairmanship of Dr. James Pelura were wonderful, happy and enthusiastic events — with the EXCEPTION of the 2007 Red, White and Blue Dinner which took place in the year after Bob Ehrlich and other Republican Legislators had been defeated by the Democrats. At that dinner, I will agree that it was more like a "morgue." Perhaps Former Governor Ehrlich forgot to remember that HE WAS THE CORPSE at that one?

I thought the Chairs of Montgomery for Ehrlich were Katja and Scott. Two amazing people. You are either in charge or you are not. So stop using these others to bash Bob. There are an awful lot of people with titles and positions all over the state on the campaign. Probably over 500-600. Then there is the paid staff, the victory staff, the paid staff of higher level campaigns. Then the rich business owners hosting big fundraisers like Sam Malhotra and Sebastian Kurian who are well ahead in line for positions and appointments.
And do not forget Dick Hug, Dirk Haire, Chris Cavey, Elaine Pevenstein, Greg James, Ed Miller, Boyd Rutherford, Kevin Igoe, and all the other big players. These people make you all look worthless and nobodies. I think of all these young turks much like the dot-com or mortgage banking boom. Quick rise, harder fall. Here today, gone tomorrow. Unemployment tax
Mr. Ehrlich has spent the past several weeks blaming his successor for a sharp increase in unemployment insurance taxes business pay, but Washington Post reporter John Wagner pointed out,
The increases are largely the result of a recession-sensitive formula that was signed into law in 2005 by Ehrlich — a fact he has glossed over while discussing the issue with irritated business owners. Ehrlich also rarely mentions a deal O'Malley and lawmakers cut with business representatives this year that will provide some relief going forward.
Even worse, when Mr. Ehrlich was governor, he did nothing when businesses were hit with the same kind of unemployment insurance surcharge he criticizes today. Gov. O’Malley, on the other hand, worked with businesses and labor this year and succeeded in softening the impact.
Maryland Republicans tried to pin the unemployment tax hike on Democrats, claiming the fund was drained by recipients seeking part-time work under a 2009 law, but the nonpartisan Department of Legislative Services showsthat change had a nominal impact and the fund was drawn down because claims increased dramatically in Maryland and all states in the deepest recession since the Great Depression.
Ehrlich’s tax hikes hit business
Only weeks after his 2003 inauguration, Mr. Ehrlich raised property taxes 57 percent and increased corporate filing fees. Businesses of all sizes own real property, and had to pay Mr. Ehrlich’s property tax hike along with their customers. The next year Mr. Ehrlich raised taxes by $2 billion, much of which fell on small and big business.
Ehrlich’s favoritism and corruption
Every time Mr. Ehrlich handed out state business to a crony or supporter, or a client of his friend David Hamilton, he took business away from a legitimate business expecting to compete fair and square for the work. Any business owner who knows this yet supports Bob Ehrlich does so in disrespect of honest business principles.

Steffen was fired in 2005, but Ehrlich and Steele's corruption went on for years before AND AFTER.
(part 1)
In May 2006, the Ehrlich-Steele administration tripled a state computer contract awarded to a company owned by Alan Fabian from $700,000 to $2.2 million without competitive bidding. It was a peculiar action because Mr. Fabian had won the contract only 11 months earlier, in June 2005, by under-bidding three competitors that state evaluators determined to be better qualified to do the work. Five other competitors were eliminated because state evaluators determined they were not qualified to do the work, and a sixth withdrew.
Two of the qualified competitors pinned the cost of the job at just under $1 million and the third bid just over $1 million, but Alan Fabian’s company won the contract even though he was the least qualified because he offered to do the work for almost half that price, $589,000. Then, only eleven months later, without competitive bidding, the Ehrlich-Steele administration tripled Mr. Fabian’s contract to $2.2 million, which was double the price offered by the more qualified competitors that he edged out the year before.
In the end, Mr. Fabian billed the state for only $980,000, an amount that was pinpointed by two of the contractors in their original offers.
The plea agreement with federal prosecutors may explain why Mr. Fabian needed the Ehrlich-Steele administration to raise the contract, originally awarded at $700,000, all the way to $2.2 million, even though in the end he only billed the state for $980,000.
The Provident Bank Loan
Mr. Fabian’s federal plea agreement says that on June 27, 2006, Baltimore based Provident Bank approved a $1.2 million line of credit to his company. A week later, on July 7, 2006, according to the plea agreement, Provident raised Mr. Fabian’s line of credit to $2 million. This action was only weeks after the Ehrlich-Steele administration tripled his state contract to $2.2 million.
The plea agreement goes on to say that Mr. Fabian ultimately defaulted on the loan as his fraud unraveled, causing Provident Bank to sustain a $4 million loss.
Close Ties to Ehrlich and Steele
Federal and state campaign disclosures show that Mr. Fabian was one of the Ehrlich-Steele administration’s top contributors, donating $285,000 to campaign committees benefitting the pair over their 4-year tenure in his own name, his wife’s name, and through various businesses he controlled. He bundled at least $100,000 more from employees and associates.
Although a steady contributor, Mr. Fabian embarked on an unmatched giving frenzy in the weeks before and after the Ehrlich-Steele administration tripled his state contract, contributing $95,000 of his own money and bundling an additional $50,000 in contributions to Mr. Steele from friends and associates. He held a high profile fundraiser at his Cockeysville home for Mr. Steele on June 23, 2006, featuring a surprise guest, Karl Rove. The invitations were likely sent within days of the Board of Public Works action to triple Fabian’s state contract.

At the time, Mr. Fabian was also the finance chairman for Mr. Steele’s campaign for the United States Senate seat being vacated by Sen. Paul Sarbanes, which Mr. Steele lost to then-Rep. Ben Cardin.
Gov. Ehrlich’s campaign fundraiser and close friend, Baltimore lawyer David Hamilton, was the counsel to Mr. Fabian’s firm. Court documents include a letter to Mr. Hamilton from Mr. Fabian’s criminal lawyer in October 2006, revealing that Mr. Hamilton was aware of the federal probe of Mr. Fabian’s affairs that led to the indictment and guilty plea. Attorney-client privilege likely prohibited Mr. Hamilton from alerting Mr. Ehrlich or Mr. Steele to the matter, but we can only speculate whether or not he counseled Mr. Fabian to refrain from pursuing state business under the Ehrlich-Steele contract and distance himself from the Steele and Ehrlich campaigns. Mr. Fabian did quite the opposite.
Flying Air Fabian
Mr. Steele’s senate campaign disclosed 6 reimbursements to Mr. Fabian’s company for "Travel," and the Republican Governors Association
disclosed a $54,000 contribution from Mr. Fabian’s company labeled "In Kind Air Travel." Court records show that Mr. Fabian used some of the money from his lines of credit to pay for a private charter jet. A spreadsheet obtained from the governor’s office through Maryland's Public Information Act shows that Mr. Ehrlich and Mr. Steele made several trips to Republican events around the country by "Private Airplane" coinciding with the dates on the campaign disclosures.
Neither Mr. Steele nor Mr. Ehrlich listed any gifts of air travel on their personal financial disclosures during their tenure. While it may not have been illegal for Mr. Ehrlich or Mr. Steele to fly around the country in Mr. Fabian's private charter jet while their administration was busy awarding him a contract under suspicious circumstances and then tripling it to $2.2 million without competitive bidding, it is certainly unethical and crying out for exposure.

Salisbury is a public land grant college whose ground are open to the general public. As are all buildings, hallways, etc. So long as guests are not disrupting any classroom activity in progress, they are allowed outside the classroom premise. Is MYRLC a student or university sanctioned activity? Under Maryland Law, University Police have no jurisdiction unless a law is being broken. A "nuisance" during any organized political activity on a public university campus is considered free speech.

The Washington Post reported in February 2005 that Joe Steffen resigned from the Ehrlich Administration in the wake of the rumor scandal. Either Colman did no research before making that libelous claim, or knew otherwise yet reported it anyway. This minimally indicates a "reckless disregard for the truth."
Further, note that Colman – who has stated that he always posts under his own name – posted as "Tyler M" yet signed it "Grant Colman" in this instance. How many of the other libelous entries here, either posted anonymously or under another name, actually came from him? A subpoena of the originating IP addresses should yield that answer.

A lawsuit would be the only way to make money people for many people. Look at daytime TV with those ambulance chaser excuses for attorneys. Since we now live in a society where men solve their differences by exploiting the law for personal gain in financial wealth, this is what some people have to do to make a living.
There is no grounds for a lawsuit of anyone. I myself have been libeled here but could care less about it. I did not get fired from it, I did not get evicted from my apartment, my wife did not leave me, and I am doing just fine.

Can you prove that David Nawrocki was the one who sent out that email and that someone didnt forge the email? Do you have concrete evidence (like mail server logs, transactional logs)? Probably not. So the email you have could be forged.

That being said Mr. Steffen, your daughter has several legal cases in public court records regarding violations of the law. One specific to being on probation. Her boyfriend's father has some very interesting things in public court records too. Is it ok if we post those here because they are public court records?
Until you can prove David Nawrocki sent out that mail with 100% accuracy, you are in the same boat Mr Steffen. As far as Im concerned, the email was forged or made to look like he sent it out from his gov account. The email is lacking in full headers and lacks copies of email logs from the SSA server, the origin address, etc. There is no proof that if he sent the mail, it was from a work computer. For all we know, if he did send such an email, it could have very well been from his house on his off time while just working hard and checking his email from home. A lot of gov employees do this you know.
So where is the proof, beyond hearsay, that he sent this email from work, during work hours, from a work computer. I have yet to see such evidence. And the onus is on you Mr Steffen to prove it, not for him to prove he did not.
I wish you the best of luck in finding and proving such information, because it is you who must meet the burden of proof. There are many friends of the Nawrockis in Partner and Of Counsel positions of the top 3 firms in DC. I should hope you are able to stand up against $1000-$2500 an hour attorneys from Harvard, Yale, Princeton, Georgetown, UVA, and other fine programs should Mr Nawrocki choose a litigious path.
Former Governor and Former Congressman Ehrlich still has a lot of friends. And last I heard, he's pretty damn loyal to his friends- and even more loyal to those who stand up for them.

If Nawrocki didn't do it, wouldn't the campaign have stated that, rather than counsel him to never do it again? And, why wouldn't Nawrocki ask the Sun to take down this blog posting if it were false?

The very same day the Maryland Republican Party criticized Gov. Martin O'Malley for e-mailing several state workers to solicit campaign donations, a Republican used his own federal e-mail account to solicit volunteers for former Gov. Robert L. Ehrlich Jr.
Both are no-nos, and both candidates' campaigns say they're working to make sure such inappropriate e-mailings don't happen again. Here's more on the O'Malley e-mails to state employees.
News of the federal e-mailing emerged yesterday on former Ehrlich employee Joe Steffen's "Darkness Rising" blog. Steffen included the e-mail itself, from David Nawrocki, a volunteer with Ehrlich's campaign. The e-mail came from an official federal e-mail account that is not supposed to be used for political purposes. It includes instructions to reply to Nawrocki's private account. An excerpt:

Ryan Mahoney, the Maryland Republican Party political director who alerted reporters to the O'Malley e-mails, has not responded to an e-mail I sent him yesterday seeking comment on Nawrocki, said it was more appropriate for the Ehrlich campaign to comment on Nawrocki.
"I do realize we just sent out a complaint about O'Malley doing it, but I think it's apples and oranges," he said. O'Malley is their boss, and it was sent to his employees.

The above is hearsay. Nice try. But the intent of Mr Steffen to post the email was to cause grave irreparable harm to Mr Nawrocki. The intention was to cost Mr Nawrocki his job and to publicly defame him and lost community credibility for his alleged actions (which have yet to be proven by any benchmark for e-discovery). Everything at this point is rumors, hearsay.
I encourage Mr Nawrocki to pursue extensive legal action against the poster for loss of credibility in the workplace and public defamation of character. Bloggers need to be held to a higher standard, as must act responsibly as they are often considered newsworthy sources. And they must be held to professional and ethical journalism standards. When they violate them, then they should be personally responsible and due care and due diligence responsibility must be accountable.

Many people have posted that Mr Nawrocki violated the Hatch Act. May I please see a copy of the charging documents or conviction document for stating he did that? By saying he violated a law without any judicial evidence stating such is in fact libel.

You are wrong. Inference and perception without a conviction or charge reagarding violation of a law is libel. Would you like me to start siting case law specific to libel and the 'inference of guilt' with regards to the Hatch Act? There is sufficient case law to prove Mr Steffen did in fact libel Mr Nawrocki, and we will be providing this information to the Nawrocki family as well as pro bono services of a top 3 DC firm in the event he would like to proceed. Many counselors at this firm are in fact former Federal Judges and might even represent Mr Nawrocki.
A lot of people are very loyal to Mr Nawrocki. We will assist him in exercising every legal option available to ensure justice is served as he and his family see fit. You need to separate yourself from emotion and evaluate facts in a non-biased manner.
As for the comments against many people here, we would like to have them consider libel cases against the author. But unfortunately, due to certain legal decisions regarding DMCA cases, IP addresses cannot be tied to individuals anymore. They are considered Personally Identifiable Information (PII) for legal purposes and unfortunately courts prohibit using them to identify individuals for non-criminal cases. We would have really liked to serve Google to disclose that information, but are no longer legally able. So I guess many of you have lucked out.

The rematch of the 2006 election is anything but dull

While the 2010 governor's race in Maryland is still in its early stages, we have already witnessed the kind of skirmishing — including controversies over e-mails, political signs and Northrop Grumman — that keep political junkies like me fully engaged.
Based on events so far, it is already possible to reach five firm conclusions about the nature of the 2010 campaign.
1) The race is competitive. Among likely voters, a May Washington Post poll and a June Rasmussen poll found former Gov. Robert L. Ehrlich Jr. and Gov. Martin O'Malley tied. While the Ehrlich-O'Malley contest appears to be a political horse race, surfing might be a better sports analogy, as evidence exists that a broader, pro- GOP wave may be surging in Maryland.
he Post poll found that 54 percent of Marylanders support the new federal health care law, while 37 percent oppose it. However, Rasmussen found that a 53 percent majority of Marylanders wanted the new law repealed, while 42 percent did not.
Given Maryland's liberal bent and the fact that the BP oil spill has largely replaced the health care debate in the headlines, this disparity is potentially astonishing.
If the Rasmussen poll is accurate, then a fundamental ideological shift has rapidly occurred, signaling very good news for Mr. Ehrlich. If it is not, general economic angst is likely driving the race, indicating a competitive contest with a slight edge still going to the incumbent.
2) Democrats are concerned about Governor O'Malley's prospects. State Democratic leaders' initial response to an Ehrlich candidacy — mailing out letters explaining how he cannot win, posting attack ads on YouTube, and attempting to pull the plug on Mr. Ehrlich's Saturday morning WBAL radio show — did not project a strong degree of confidence in their own candidate. The talented partisans at the state Democratic headquarters could have achieved this by promoting Governor O'Malley's record instead of engaging in petty sniping.
3) This is Ehrlich Part 2, not Ehrlich 2.0. The Bob Ehrlich running in 2010 is the same guy who ran in 2002 and 2006. The candor is back, as is the willingness to discuss a wide range of public policy issues — sometimes at the expense of message discipline. So is the Blues Brothers-style "We're getting the band back together" approach to campaigning. So is the tendency to articulate a broad message of change and electability without offering many specifics.

Rasmussen released poll results late last week showing that Governors Ehrlich and O'Malley are tied at 45% each. Rasmussen's poll should be viewed against its other polls in the gubernatorial race where they had O'Malley over Ehrlich, 49% to 43%, in February. In April, O'Malley's lead dropped to 47% to 43%. Now, the two are tied at 45%. This is not a good sign for O'Malley, as he is trending downwards.
O'Malley took to the airwaves early to attack Ehrlich. First, a 527 Political Action Committee ran ads in April, the week that Ehrlich announced his candidacy, claiming that Ehrlich was a lobbyist representing "special interests". This allegation is demonstrably false. Ehrlich was not a lobbyist, although the firm he works for may have lobbyists on staff.
Still, the O'Malley campaign claims, as recently as today (June 14, 2010) in an email sent to campaign supporters:
Bob Ehrlich spent the last four years as a special interest lobbyist, representing big oil, big tobacco, Wall Street banks and giant utilities.
Second, O'Malley took to running radio ads through his campaign, including on the "Bob and Kendel Show" on WBAL Radio 1090. These ads claim that Ehrlich lives in a Fantasyland, that there was not an $800 million surplus left when Ehrlich left office, and the ad quotes Ehrlich's budget secretary as saying that the surplus will be needed to balance the next year's budget.
The ad does not prove what it says it proves. It admits there was an $800 million surplus, but seems to argue that because that had to be used to balance the next year's budget, it was not really a surplus. If you know that hard times are coming, and you save money to prepare for those times, isn't that more fiscally responsible than simply spending the money in your pocket? Ehrlich could have spent the $800 million in an election year to pay off "special interest groups" for his re-election bid.
These false ads being aired by O'Malley, or his supporters in the case of the 527 PAC, have not gained the O'Malley any traction in the polls. If anything, they have resulted in him losing ground to Ehrlich. Still, given his campaign email today, it does not appear as if O'Malley is changing his strategy yet.
The O'Malley campaign email sent today is also remarkable in that they bring up the Public Service Commission:
We all remember the cozy relationship that Bob Ehrlich's Public Service Commission had with big utility companies.
The hubris to make this claim in the face of the facts is amazing. First, O'Malley campaigned that he would lower our BGE rates. The rates increased. Then, after he appointed his people to the Public Service Commission, he proposed that the five members he appointed receive a 46% increase in salary. Who's serving the special interests, again?

Former Gov. Robert L. Ehrlich, Jr. (R) on Wednesday blasted Gov. Martin O'Malley's decision to slash the state's film industry tax credit, which he said was partially responsible for bringing "The Wire," "Homicide," "Ladder 49" and other productions to Maryland during his tenure.
Ehrlich said that if returned to the governor's office, he would restore the annual credit from $1 million to $7 million. The credit is one of hundreds of areas in which O'Malley has cut the state budget during consecutive years of $1.9 billion shortfalls.
"Cutting this tax credit is no different than cutting jobs," Ehrlich said. "It's an expenditure that produces a huge return on a small investment."
A report last year said the film industry generated $158 million in economic impact in the state during Ehrlich's last year in office. Louisiana and several other states have recently won sought-after arrangements to host HBO and other series productions.

Rx from O'Malley campaign: "Every job is important and [the Maryland Department of Business and Economic Development] has been reviewing productions on a project by project basis," says campaign spokesman Rick Abbruzzese in an e-mail. "We have $1 million in the fund now, but if the right production came along, I think DBED would find a way to make it work."

For the first election in many, “small business” is the buzz word in place of the typical “middle class” and “working families.” Both candidates have spent much of recent weeks visiting companies, showcasing proposals to aid businesses and grandstanding for job creation.
Small-business owners say it’s deserved attention, given the economy. Programs O’Malley enacted this year are helping them to make new hires, and proposals from Ehrlich could help relieve them of high tax burdens. But at the same time, both candidates have their criticisms. And some fear it’s just campaign talk, that once the campaign ends, the honeymoon will be over.
Businesses say they could use all the help they can get to create jobs. And that’s what voters are looking for, whether they are jobless themselves or their next-door neighbor, friend or family member is.
“Jobs are definitely, I think, the priority this year,” said Tom Taylor, one of two principals with Chesapeake Financial Advisors in Towson. “If you don’t have a job, you may decide to vote one way or another. It resonates with just about every voter, because everyone needs a job.”
O’Malley campaign spokesman Tom Russell emphasized that small businesses have been a large part of the governor’s administration for four years. The governor, a Democrat, has been more vocally pushing a pro-jobs message since the start of the year, launching a legislative package aimed at helping businesses recover from the recession.
That package included more money for the jobless to keep spending in the local economy, help for small businesses seeking loans, and an incentive for companies to hire unemployed workers. The latter program, which gives companies a $5,000 tax credit for each unemployed person they hire, helped 71 employers hire 122 people as of June 7.
Ehrlich, meanwhile, has attacked O’Malley’s record from earlier in his term, including increases in sales and corporate and personal income taxes. He pledged to roll the sales tax back from 6 percent to 5 percent and has also called for revamping the state’s unemployment insurance system to make it less expensive for employers.
Spokesman Andy Barth said the Republican former governor also plans to reverse what he calls an “adversarial” relationship between businesses and their regulators, and to cut red tape that keeps businesses from connecting with government.
Tim Mudd, the other principal at Chesapeake Financial, said he sees benefits in both candidates’ proposals. His firm was one of the 71 to take advantage of the hiring tax credit, adding a third employee to help with back office operations in April. That wouldn’t have happened without the incentive, he said. And the benefit is that his new hire will be spending her wages on other local business and helping to send more tax revenue to the state.
He said he supports such incentive programs, because business is going to need some coaxing to resume activity. For the same reason, tax cuts like the one Ehrlich has proposed would help.
But others say they aren’t connecting with the candidates’ pro-small business messages. Both candidates have criticized the other’s campaign as lacking in specifics, and some businesspeople agree.
“I’d say it’s not resonating a lot with me,” said Rick Peters, president of Solar Energy Services Inc. in Millersville. “Maybe as it starts to get more specific, it will.”

Republican challenger Robert Ehrlich now leads Maryland Gov. Martin O'Malley in the rematch of their 2006 gubernatorial contest, according to a new poll released Friday.
Mr. Ehrlich has opened up a 3 percentage point lead over the Democratic governor in one of the nation's more liberal states, according to an automated survey of over 750 likely voters by the polling firm Magellan Strategies. It is the first poll to show the one-term former GOP governor ahead in the race.
According to the Magellan poll, Mr. Ehrlich was preferred by 46 percent of state voters to 43 percent for Mr. O'Malley, a close political ally of President Obama. About 4 percent of those polled preferred another candidate and 7 percent were undecided.
The spread was within the poll's 3.5 percent margin of error, but another finding suggested more political troubles for the Democratic incumbent. Only 41 percent of Maryland voters said they had a favorable opinion of the governor, compared to 45 percent with an unfavorable opinion. For Mr. Ehrlich, 51 percent of voters reported having a favorable opinion vs. 32 percent with a negative opinion.
Mr. O'Malley still claimed a slight edge with the state's crucial independent voter bloc, leading by a 38 percent to 34 percent margin, but nearly a third of the independent vote is either backing another candidate or is still up for grabs, according to the Magellan poll.
Mr. O'Malley ousted Mr. Ehrlich in 2006 by a 52 percent to 46 percent margin. The political reporting site CQToday.com rates Mr. O'Malley as a slight favorite to defeat Mr. Ehrlich again in November.

Md. GOP is ready to win, Ehrlich says
Close to 700 upbeat Maryland Republicans filled a hotel ballroom Thursday night to celebrate the state party's return to solvency and tout their candidates' prospects in November.
Former governor Robert L. Ehrlich Jr. (R), who is running to get his old job back, was among those who contrasted the mood at the party's 20th annual Red, White and Blue dinner with that of recent years.
Instead of "a morgue," the room was filled with "a bunch of people ready to win," Ehrlich told the crowd, which also heard speeches from National Republican Committee Chairman Michael S. Steele and former Massachusetts governor Mitt Romney (R).
In the wake of Ehrlich's 2006 loss to Gov. Martin O'Malley (D), the Maryland GOP struggled to overcome poor morale and infighting among party leaders and, until recently, had been mired in debt.
Party chairwoman Audrey Scott, who took over last fall and hired new staff, told the crowd that last month "the Maryland Republican Party became solvent for the very first time in over three and a half years. … It's not only that we've paid all our bills. We have money in the bank."
Party staff said Thursday night's dinner raised about $200,000, which will be used for field operations leading up to November.
Steele, Ehrlich's former lieutenant governor, said the state party was experiencing a renaissance and introduced Ehrlich as "the once and future governor of the great state of Maryland."
Steele cautioned the crowd against becoming overconfident even as some polls show a very competitive race, however.
"My friends, don't screw this up," Steele said. "We've got work to do."
Romney, who ran for president in 2008 and is angling to do so again in 2012, said "the only way this state is going to create jobs again is if Bob Ehrlich is your governor."
In his remarks, Ehrlich confirmed that his wife, Kendel, will become the sole host of the couple's weekly radio show on WBAL once Ehrlich officially files as a candidate next month.
Earlier, Ehrlich told reporters he is considering several possible lieutenant governor candidates, but plans an announcement "no time soon." By law, Ehrlich must have a running mate by July 6, the filing deadline for gubernatorial candidates.
